Customer information, communications and privacy – Samoa Telecommunications Act 2005

Samoa Telecommunications Act 2005 75A-75B: Prevent staff from divulging overheard calls or personal information

An employee of a service provider commits an offence (fine up to 50 penalty units, up to six months in prison, or both) by disclosing without good cause information from a telephone conversation overheard in the course of duty, or by disclosing or using, without good cause, information or documents about another person's affairs or personal particulars (including unlisted numbers or addresses) obtained in the course of duty, unless reasonably necessary for criminal law enforcement or protecting public revenue or otherwise authorised by law (75A-75B); providers therefore need staff confidentiality controls.
