Chapters 7 to 9: Easements and support, dispositions to defraud creditors, perpetuities, corporations and the registrar – Queensland Property Law Act 2023

Queensland Property Law Act 2023 179-182: Support for land, statutory rights of user, modification of easements, no prescriptive interests

What does 179-182 require?

The owner of supporting land owes the owner of supported land a duty of care in negligence not to adversely affect support, and the reverse (section 179). The court may impose a statutory right of use over land where reasonably necessary and may modify or extinguish an easement or covenant on the grounds sections 180 and 181 provide; no interest in land is created by prescription (section 182); and sections 183 to 188 deal with encroachment and improvements made under mistake.
