Protective Security Policy Framework (PSPF) Release 2026 0160: 0160 Procedural fairness in adverse clearance decisions

Requirement 0160 (Part Five: Personnel, section 19.7 Personnel Security Vetting Process; applies to Authorised Vetting Agencies; dated 31 October 2024; retained from Release 2025): The Authorised Vetting Agency applies the rules of procedural fairness to security clearance decisions that are adverse to a clearance subject, including decisions to deny a security clearance (including grant lower level) or grant a conditional security clearance, without compromising the national interest. The hearing rule, the bias rule, a sound evidentiary base and diligent inquiry apply; separate arrangements cover ASIO-based denials; review routes include the AVA, Merit Protection Commissioner, Ombudsman, the Administrative Review Tribunal for ASIO assessments and judicial review.
