Privacy and Other Legislation Amendment Act 2024 (Australia) Sch2.8: Schedule 2 clause 8: defences an organisation must be able to show

What does Sch2.8 require?

It is a defence that the invasion was required or authorised by or under an Australian law or court or tribunal order; that the plaintiff, or a person lawfully authorised for them, expressly or impliedly consented; that the defendant reasonably believed it necessary to prevent or lessen a serious threat to a person's life, health or safety; or that it was incidental to the lawful defence of persons or property and proportionate, necessary and reasonable. Where the invasion was by publication, the defamation-law defences of absolute privilege, publication of public documents and fair report of proceedings of public concern are available on the same footing.
