An individual has a cause of action in tort against a person who invaded their privacy by intruding upon their seclusion (including physically intruding into private space, and watching, listening to or recording private activities or affairs), where a person in the plaintiff's position would reasonably have expected privacy in all the circumstances, the invasion was intentional or reckless and serious, and the public interest in the plaintiff's privacy outweighed any countervailing public interest (such as freedom of expression and of the media, proper administration of government, open justice, public health and safety, national security, prevention and detection of crime and fraud). It is actionable without proof of damage. The court may weigh the means and technology used, the purpose, the plaintiff's attributes and conduct and the place of intrusion; for seriousness, the likely offence, distress or harm to dignity, whether the defendant knew or ought to have known that, and malice. The Schedule binds the Crown.
