Privacy and Other Legislation Amendment Act 2024 (Australia)
Schedule 1: Privacy reforms (duties on APP entities) – Privacy and Other Legislation Amendment Act 2024 (Australia)

Privacy and Other Legislation Amendment Act 2024 (Australia) APP8.3: APP 8.2(aa) and 8.3: disclosure overseas to a prescribed country or binding scheme

What does APP8.3 require?

Schedule 1 Part 6 adds an exception to APP 8.1's accountability for overseas recipients: APP 8.1 does not apply where APP 8.3 applies, that is where the overseas recipient is subject to the laws of a country, or participates in a binding scheme, prescribed by regulations, and any conditions attached to the prescription are satisfied. New s 100(1A) lets a country or scheme be prescribed only if the Minister is satisfied it protects personal information in a way at least substantially similar overall to the APPs with enforcement mechanisms available to the individual; s 100(1B) allows conditions by entity class or kind of information. Applies to information disclosed after 11 December 2024.
