The Commissioner (or an SES-equivalent member of staff) may give an entity a compliance notice where they reasonably believe it contravened s 13K(1) or (2); the notice names the entity, details the contravention and specifies action to take or refrain from taking to address it, and steps to stop it recurring, within a reasonable period, and may require reasonable evidence of compliance. Failing to comply is a civil penalty provision (maximum 200 penalty units, infringement notice available). Compliance is not an admission; the entity may seek review in the Federal Court or the Federal Circuit and Family Court (Division 2) on the grounds that it did not contravene or the notice is defective (s 80UD).
