Parts 40 to 49: Tanks, forest operations, temperature extremes, materials handling and storage, battery rooms, personal protective equipment, rigging, compressed air and diving, asbestos – Prince Edward Island Occupational Health and Safety Act General Regulations

Prince Edward Island Occupational Health and Safety Act General Regulations P49: Asbestos: prohibitions on use and installation, competent sampling of suspected material, an inventory, a management plan implemented and communicated, exposure monitoring, engineering and work practice controls to keep exposure within limits, asbestos work only by certified contractors with prior notification to the Director, and the Director's power to suspend certificates

What does P49 require?

In every workplace where asbestos is present, no person uses, applies or installs asbestos or asbestos-containing material or does the other acts section 49.3 prohibits. The employer or owner ensures a competent person collects representative samples of suspected material and has them analysed, prepares and maintains an inventory of asbestos-containing material and makes it available as section 49.5 requires, and develops, implements and communicates to workers an asbestos management plan that prevents identified material from becoming airborne and protects workers if it does, with the contents the Part lists. Where needed for protection the employer or owner monitors airborne asbestos and worker exposure by a method the Director approves, and employers, owners and contractors use engineering controls, work and hygiene practices and facilities to keep exposure within the limits in section 49.8. Asbestos work is undertaken only by a holder of a current asbestos contractor's certificate, who notifies the Director in writing before starting with the particulars in section 49.10 and follows the work procedures of the Part; the Director can suspend or revoke a certificate for contravention.
