Chapter IV and IRR Rule 7: Duties of service providers and persons holding computer data – Philippines Cybercrime Prevention Act (RA 10175)

Philippines Cybercrime Prevention Act (RA 10175) IRR Sec. 30(f): Assistance with collection or interception of data under a court warrant

What does IRR Sec. 30(f) require?

Service providers must collect or record by technical or electronic means, or cooperate and assist law enforcement or competent authorities in collecting or recording, computer data associated with specified communications, but only on the issuance of a court warrant (IRR Section 13; a Warrant to Intercept Computer Data under the Rule on Cybercrime Warrants). Section 12 of the Act, which let law enforcement collect traffic data in real time without a warrant and required providers to cooperate, was declared void in Disini (2014); the IRR recast the duty on a warrant basis.
