NSW Food Regulation 2025
Parts 11 and 12 and the remaining schedules: fees and charges, auditor reports, offences, savings, penalty notices, licence fees, amendments and dictionary – NSW Food Regulation 2025

NSW Food Regulation 2025 186-187: Non-licensed food businesses pay inspection charges (370 dollars an hour, minimum half hour) and any annual administration charge within the notice period, scaled by full-time equivalent food handlers per premises

What does 186-187 require?

A food business that does not need a licence (for example most retail and food service businesses) pays the inspecting enforcement agency, whether the Food Authority, a council, the Lord Howe Island Board or the Kosciuszko National Park authority, 370 dollars an hour for a section 37 inspection, with a half hour minimum and no travel time, indexable to Sydney CPI. A council or other agency may also levy a yearly administration charge per premises of up to 570 dollars (5 or fewer full-time equivalent food handlers), 1,170 dollars (more than 5 up to 50) or 5,115 dollars (more than 50), but only if it plans at least one inspection that year; the business must pay within the period in the notice. The charge is refunded if no inspection occurs, pro-rated if the business becomes licensed, may be deferred or waived on application, and does not apply to charity or community fundraising businesses.
