NSW Fair Trading Act 1987
Part 5: Regulation of commercial agents (debt collection, repossession and process serving) – NSW Fair Trading Act 1987

NSW Fair Trading Act 1987 60F-60N: Commercial agents: show cause, exclusion and restriction orders, cancellation, register, rules of conduct

What does 60F-60N require?

The Secretary may require a licensee or any person to show cause why an exclusion order (prohibiting the person from carrying out commercial agent activities) or a restriction order should not be made, may make such orders and may cancel a licence (sections 60F to 60H), subject to NCAT review (section 60I). The Secretary keeps a register of licences, refusals, prosecutions, orders and cancellations (section 60J). The commercial agent rules prescribed by regulation set the rules of conduct, prohibiting physical force, harassment, coercion, misrepresentation, unreasonable threats, illegal entry, impersonating a government employee, exposing a person to ridicule, employing disqualified persons, and the other practices listed, and requiring the records, identification and contact-frequency practices the rules specify (section 60K). Section 60M exempts lawyers, government agencies and the other persons listed.
