NSW Fair Trading Act 1987
Part 5: Regulation of commercial agents (debt collection, repossession and process serving) – NSW Fair Trading Act 1987

NSW Fair Trading Act 1987 60B-60E: Commercial agent activities: disqualified persons prohibited, field agents and their employers licensed, fit and proper

What does 60B-60E require?

A commercial agent activity is debt collection, repossession of goods or process serving carried out on behalf of another (section 60). A disqualified person (section 60A: convictions for offences of dishonesty, violence or drugs within the period specified, undischarged bankrupts, persons subject to exclusion orders) must not carry out a commercial agent activity, nor may a corporation whose officer is disqualified (section 60B). A person must not approach the subject of the activity, enter or attempt to enter premises where the subject resides, works or regularly attends, or approach property of the subject, unless the person holds a commercial agent licence (a field agent), and a person must not employ or engage a field agent unless the employer holds a licence (section 60C). Licences are issued by the Secretary only to fit and proper persons (sections 60D, 60E), with mutual recognition under section 60AA and a 12-month restoration window for lapsed licences (section 60EA).
