NSW Conveyancing (Sale of Land) Regulation 2022
Conveyancing Act Part 4 Division 10 and Regulation Part 2 Division 3: Off the plan contracts (disclosure statement, notice of changes, rescission, sunset clauses) – NSW Conveyancing (Sale of Land) Regulation 2022

NSW Conveyancing (Sale of Land) Regulation 2022 Act-66ZN: Off the plan: serve a notice of changes at least 21 days before completion when the disclosure statement is or becomes inaccurate in a material particular

What does Act-66ZN require?

If the vendor becomes aware that the disclosure statement was inaccurate in relation to a material particular when the contract was signed or has become so afterwards, the vendor must serve on the purchaser, at least 21 days before completion, a notice of changes in the approved form; service on the purchaser's authorised representative suffices. Material particulars are defined in section 66ZL and clause 24 (changes to the draft plan, the by-laws, management statements and development contracts that adversely affect use or enjoyment, the schedule of finishes and the other listed matters, excluding lot-number, street-name and minor changes).
