Nigeria Data Protection Regulation (NDPR) 2.11: Transfer abroad only to jurisdictions with an adequacy decision, under HAGF supervision

Transfers of personal data to a foreign country or international organisation are subject to the Regulation and the supervision of the Honourable Attorney General of the Federation (HAGF); a transfer may take place where the Agency has decided that the country, territory, sector or organisation ensures an adequate level of protection. The HAGF weighs the destination's rule of law, human rights, legislation and public authority access, its data protection and onward-transfer rules and enforceable rights and redress, the existence of an independent supervisory authority, and its international commitments. The Implementation Framework's Annexure C white list gave the adequacy positions in practice.
