New Zealand Credit Contracts and Consumer Finance Act 2003
Part 3A: Repossession of consumer goods – New Zealand Credit Contracts and Consumer Finance Act 2003

New Zealand Credit Contracts and Consumer Finance Act 2003 83L-83M: Disabling devices: activate only under a contractual right, after the warning notice period and never in the circumstances the Act forbids

What does 83L-83M require?

Where a consumer credit contract gives the creditor a security interest over goods fitted with a disabling device and a right to activate it, neither the creditor nor its agent may activate the device unless the debtor is in default, the repossession warning notice has been served and its remedy period has expired, and the other conditions in section 83L are met; a disabling device must not be connected or used in connection with goods in the circumstances section 83M prohibits, and the debtor must be given the warnings and information the sections require.
