Under GDPR art. 9(2)(h), a person who is not a care provider (for example an heir or trustee in bankruptcy holding a practice's records) may transfer medical records, for their retention and management under art. 7:454 Civil Code, to a care provider, institution or facility that will keep and manage them; the confidentiality duty of art. 30(4) and the notice, free-of-charge and no-consent rules of art. 30a(3) to (6) apply.
