NAIC Unfair Claims Settlement Practices Model Act (MDL-900) and Model Regulation (MDL-902) mdl902-s5-disclose-benefits-no-concealment: Disclose to first party claimants all pertinent benefits, coverages and provisions; agents must not conceal them

What does mdl902-s5-disclose-benefits-no-concealment require?

No insurer may fail to disclose fully to a first party claimant all pertinent benefits, coverages or other policy provisions under which a claim is presented, and no agent may conceal pertinent benefits, coverages or provisions from a first party claimant. A claim cannot be denied for failure to exhibit property unless the file documents a breach of the policy condition, and a claim cannot be denied for late written notice of loss unless written notice is a policy condition or the claimant's failure after a request is so unreasonable that it breaches the duty to cooperate.
