NAIC Annual Financial Reporting Model Regulation (Model Audit Rule, MDL-205) mdl205-s7l-cooling-off: Do not use an accountant where a senior officer or director was on its audit team for the insurer in the past year

The commissioner will not recognise an accountant as qualified for an insurer if a director, the president, the chief executive, the controller, the finance chief, the chief accounting officer or anyone in an equivalent post worked for the accountant on that insurer's audit at any time in the year before the date the most recent statutory opinion is due. The restriction reaches partners and senior managers on the engagement. Relief is available on application for unusual circumstances, the approval being filed with the annual statement in each State and with the NAIC.
