30-14-2809: authorized agents and opt-out methods – Montana Consumer Data Privacy Act

Montana Consumer Data Privacy Act 30-14-2809(3)(b): recognise opt-out preference signals from 1 January 2025

What does 30-14-2809(3)(b) require?

From 1 January 2025 a controller must let consumers opt out of targeted advertising and sale through an opt-out preference signal sent with the consumer's consent by a platform, technology or mechanism that does not unfairly disadvantage another controller, uses no default setting but requires an affirmative, freely given and unambiguous choice, is consumer-friendly, is consistent with federal and state law, and lets the controller determine whether the consumer is a Montana resident and has made a legitimate opt-out request.
