A financial institution may record telephone communications with its corporate and institutional trading partners in the ordinary course of business only if it establishes and maintains a procedure giving those partners written notice every six months that calls on designated lines will be recorded. Financial institution means a bank under G.L. c. 167 s. 1 or an investment bank, securities broker or dealer, investment adviser, mutual fund, investment company or securities custodian; trading partners are the institutions and businesses engaged with it in cash and asset management, custody, securities trading and wholesale capital markets.
