Kenya Competition Act (Cap. 504)
Parts IV and V: mergers and unwarranted concentrations of economic power – Kenya Competition Act (Cap. 504)

Kenya Competition Act (Cap. 504) 50-52: Unwarranted concentrations of economic power: grant access to records and comply with disposal orders

What does 50-52 require?

The Authority reviews the structure of production and distribution for concentrations of economic power whose detriment outweighs any efficiency of integration; it may investigate a sector and require any participant to give it access to records on ownership patterns, market structure and sales percentages, and to provide copies (section 50(2) and (3)). After a hearing conference it may order a person holding an unwarranted concentration to dispose of such of its interests in production, distribution or supply as are necessary, and to observe other conditions, allowing sufficient time for orderly disposal (sections 51 and 52); contravention is an offence (section 54).
