What does 47 require?

The Authority may revoke a merger approval, after thirty days' notice and representations, where a merger party was responsible for materially wrong or misleading information on which the decision rested, or where a material approval condition is breached, and may add a financial penalty of as much as a tenth of the prior year's gross turnover (section 47(1) to (3)). A merger party whose information is materially wrong or misleading, or that fails to comply with a condition, leading to revocation commits an offence punishable by a fine of up to ten million shillings or five years' imprisonment or both (section 47(4)).
