Kenya Competition Act (Cap. 504) 31: Investigation notices: furnish information, produce documents, appear and supply copies of records

What does 31 require?

Where the Authority investigates alleged restrictive trade practices, abuse of dominance or abuse of buyer power, it may by written notice require any person to furnish specified information in writing signed by the person or a director or competent officer, produce specified documents or articles, appear at a stated time and place to give evidence or produce documents, and hand over copies of relevant records or submit them for copying, by the deadline and in the way the notice sets (section 31(4)). Evidence may be taken on oath, and a person attending has the immunities of a High Court witness (section 33). Failure to comply with a summons, refusing the oath, refusing to answer, giving evidence known to be false or failing to produce documents in one's possession or control are offences (section 88).
