A professional association (the controlling body of a recognised profession, not a trade association or lobby body) whose rules contain a restriction that prevents, distorts or lessens competition must apply in writing to the Authority for exemption; the Authority may exempt the rules, wholly or in part, for a specified period where, having regard to internationally applied norms, the restriction is reasonably required to maintain professional standards or the ordinary function of the profession, after Gazette notice, thirty days for representations and consultation with the responsible ministry (section 29(1) to (4)); exemptions may be revoked on the same process (section 29(5)). An association that fails to apply, or applies restrictive rules outside an exemption, is subject to the Part III prohibitions (section 29(8)).
