Part III Sections A to C: restrictive trade practices, abuse of dominance and abuse of buyer power – Kenya Competition Act (Cap. 504)

Kenya Competition Act (Cap. 504) 23-24: Dominant undertakings: no unfair prices or terms, output or access restriction, discrimination, tying or IP abuse

What does 23-24 require?

An undertaking is dominant if it controls at least half the goods or services of a description in Kenya (or in a substantial part of the country), or forty to fifty per cent of the market unless it shows it lacks market power, or less than forty per cent but with market power (section 23). Abusing a dominant position in Kenya, or in a substantial part of the country, is prohibited, including imposing (directly or through others) unfair buying or selling prices or other unfair terms of trade; limiting production, outlets, market access, investment, distribution or technical development through predatory or other practices; applying dissimilar conditions to equivalent transactions; tying contracts to unrelated supplementary conditions; and abuse of an intellectual property right (section 24(1) and (2)). Contravention is an offence (up to five years' imprisonment or a fine of ten million shillings or both, section 24(3)) on top of the Authority's turnover-based fine of as much as a tenth.
