Part III Sections A to C: restrictive trade practices, abuse of dominance and abuse of buyer power – Kenya Competition Act (Cap. 504)

Kenya Competition Act (Cap. 504) 21-4: Recommended resale prices: expressly non-binding and labelled 'recommended price'

What does 21-4 require?

A supplier or producer may recommend a resale price to a reseller or service provider only if it states expressly to the reseller that the recommendation does not bind, and, where a price is affixed to the product or to any related document or thing, 'recommended price' is printed beside it (section 21(4)). Enforcement of a price floor by threats, supply withdrawal or conditional rebates is minimum resale price maintenance under section 21(3)(d).
