Part 130: Political contributions, fees and commissions – ITAR - International Traffic in Arms Regulations

ITAR - International Traffic in Arms Regulations 130.9-130.11: Report political contributions, fees and commissions above the thresholds

What does 130.9-130.11 require?

Each applicant must tell DDTC whether it or its vendors paid, offered or agreed to pay, for the sale concerned, political contributions totalling $5,000 or more or fees or commissions totalling $100,000 or more, and if so furnish the 130.10 information as a condition of the licence; suppliers must do the same within 30 days of a DoD contract award; contributions by fee recipients count as the payer's; a later discovery that the thresholds were met must be reported within 30 days with reasons (130.9). The report gives the contract price, the applicant, the foreign purchaser and end user, and for each payment the amount, date, recipient, payer, form and the recipient's details and relationships, with payments up to $2,500 (contributions) or $50,000 (fees) reportable in aggregate as miscellaneous (130.10). Supplementary reports are due within 30 days of new payments of $2,500 or $50,000 or more, material changes, or a DDTC request (130.11).
