A DSP-5 is required to export unclassified technical data unless an exemption applies, and details of proposed discussions in a plant visit must be sent to DDTC for appraisal (125.2(a)); a licence is needed for oral, visual or documentary disclosure by U.S. persons to foreign persons in any manner, including during visits to foreign missions (125.2(c)); patent filings beyond what supports an application need a licence and follow 37 CFR part 5 (125.2(b)). Technical data licences and exemptions may not be used for foreign production or technical assistance without DDTC approval, normally via Part 124 (125.1(b)); exported data may not be reexported, diverted or disclosed to a national of another country without prior written approval (125.1(c)); and approvals cover only what was described (125.1(f)).
