Preservation aims to keep ESI identified as within a preservation obligation in its original or existing state from the trigger onward, so that nothing potentially relevant is altered or destroyed and spoliation does not occur. The objectives reach both ESI the organization holds and ESI held for it by others; they involve choosing between preserving in place (custodian self-preservation or technical in-place holds, with collection later if the matter needs it) and preserving by collection, which is itself a form of preservation; and they keep the approach proportionate and defensible, because preservation duties differ between jurisdictions and there is no single yardstick for adequacy or for a party's exposure if it fails.
