All client and third-person funds go into the pooled account unless they are placed either in a separate interest-earning trust account dedicated to that person or matter, with net interest paid to them, or in a pooled account with sub-accounting that computes and pays each person's net interest. Where the money could produce a positive net return for its owner, the lawyer must use one of those alternatives. The judgement weighs the amount, the expected holding period including likely delay, available interest rates, the cost of setting up and administering a separate account (service charges, the lawyer's time and any tax reporting), the institution's ability to compute interest per client, and any other circumstance affecting the net return.
