A person must not knowingly and intentionally manufacture, assemble, distribute or possess any electronic, mechanical, eavesdropping or other device knowing or having reason to know that its design makes it primarily useful for surreptitious overhearing, transmitting or recording of private conversations or interception or transcription of private electronic communications, where its intended or actual use is contrary to the Article. Under 14-2(c), manufacturers, suppliers and communication service providers (and their agents, employees, contractors and vendors) may make, sell or possess such devices in the normal course of business for purposes not contrary to the Article, as may law enforcement and Department of Corrections staff for official duties.
