Germany Works Constitution Act (BetrVG) s111: s 111 Inform and consult the works council on operational changes that may substantially disadvantage staff

In companies normally employing more than 20 employees with voting rights, the employer informs the council fully and in good time of planned operational changes that may entail substantial disadvantages for the staff or a large part of it, and consults on them; in companies with more than 300 employees the council may engage a consultant. Operational changes include reductions or closures, relocation, mergers and splits, fundamental changes in organisation, purpose or plant, and the introduction of fundamentally new working methods and production processes (which can include company-wide digital monitoring or algorithmic management systems). Failure to inform is an administrative offence (s 121).
