FINRA Rule 2111 Suitability (United States)
Rule 2111(a): the suitability obligation and the customer investment profile – FINRA Rule 2111 Suitability (United States)

FINRA Rule 2111 Suitability (United States) 2111a-reasonable-basis: Have a reasonable basis to believe each recommended transaction or strategy is suitable for the customer

Before recommending a securities transaction or an investment strategy involving securities, the firm or its representative needs grounds, reasonable ones, for believing the recommendation fits that customer. Those grounds must rest on the information gathered through the firm's own reasonable diligence to learn the customer's investment profile, not on assumptions or on the customer's unsupported say-so. The obligation attaches to the recommendation, whether or not the customer follows it, and it cannot be contracted away.
