FINRA Rule 2111 Suitability (United States)
Rule 2111(a): the suitability obligation and the customer investment profile – FINRA Rule 2111 Suitability (United States)

FINRA Rule 2111 Suitability (United States) 2111a-profile: Collect and analyse the customer investment profile: age, other investments, financial situation, tax status, objectives, experience, horizon, liquidity, risk tolerance

The rule lists what makes up the profile: how old the customer is, what else they hold, their financial position and needs, their tax position, what they are trying to achieve, how experienced they are, how long they can invest, how much liquidity they need, how much risk they will bear, and anything else they tell the firm when the recommendation is made. Under Supplementary Material .04 the firm must diligently gather and weigh every one of these factors; a factor can be left out only where the firm records, specifically, why it does not matter in the circumstances. New-account forms, periodic profile refreshes and the record of what the customer said are the evidence.
