EU Platform Work Directive (Directive 2024/2831) 4: Article 4 Correct employment status determined on the facts

Employment status is ascertained primarily from the facts of the actual performance of work, including the use of automated monitoring or decision-making systems in organising the work, irrespective of how the contract designates the relationship; where an employment relationship is established, the party or parties carrying the employer's obligations must be clearly identified. For a platform this means classifying persons on the operational reality of control, not the contract label, and naming the responsible employer entity.
