Three classes of radio equipment are subject to the privacy and personal data requirement whenever they can process personal, traffic or location data, even without an internet connection: equipment meant solely for childcare, radio toys within the Toy Safety Directive, and body-worn equipment (worn on the body, strapped to it or hung from clothing). Recital 12 explains why: these products emit and receive radio signals carrying sensitive data about children and about the wearer's body and habits, and a short-range link without safeguards can be intercepted as easily as an internet one. For toys and childcare equipment the Commission's guidance on EN 18031-2 adds that access control must include parental or guardian control; an implementation category that cannot deliver it loses the presumption of conformity. Manufacturers of these products must document the data the device can capture, protect the radio link and local storage, and provide the guardian-level controls the child's context demands.
