Part Two: Own funds and eligible liabilities – EU Capital Requirements Regulation (Regulation (EU) No 575/2013)

EU Capital Requirements Regulation (Regulation (EU) No 575/2013) 72a-72l: Eligible liabilities of resolution entities: qualifying instruments, deductions and the own funds and eligible liabilities total

What does 72a-72l require?

For the G-SII and resolution entity requirements, eligible liabilities instruments must be directly issued and fully paid, not owned by the institution or its resolution group, not funded by the resolution entity, wholly subordinated to the excluded liabilities (with the stated exceptions), carry no incentive to redeem, not be redeemable by holders before maturity except as Article 72c allows, give holders no right to accelerate payments other than in insolvency or liquidation, and not have payments that vary with the issuer's credit standing; only instruments with at least one year of residual maturity count (Article 72c). Holdings of own eligible liabilities and of other G-SII entities' eligible liabilities are deducted, and the institution's own funds and eligible liabilities are the sum of own funds and eligible liabilities after deductions.
