EU ATEX Directive (Directive 2014/34/EU) 38: End formal non-compliance with marking, declarations, technical documentation and contact details

What does 38 require?

When a Member State finds a formal non-compliance, the economic operator must put an end to it: CE marking affixed wrongly or missing, Ex marking, group and category symbols or other point 1.0.5 information wrong or missing, the notified body number wrong or missing where that body is involved in production control, the declaration or attestation missing or incorrectly drawn up, technical documentation unavailable or incomplete, manufacturer or importer details absent, false or incomplete, or any other administrative requirement of Articles 6 or 8 unmet. If it persists, the product is restricted, prohibited, recalled or withdrawn.
