EPA RCRA Hazardous Waste Management 262.83: § 262.83 Exports of hazardous waste

Exporting hazardous waste requires: a written contract, chain of contracts or equivalent arrangement naming the parties, providing for alternate management and return, confirmation of receipt within three working days and of recovery or disposal within 30 days of completion and no later than one calendar year after receipt, financial guarantees where required, and compliance by every party (copies to EPA on request); an electronic notification to EPA through WIETS at least 60 days before the first shipment with the listed content (exporter, foreign receiving facility and importer, transporters, waste descriptions and quantities, recovery or disposal operations, ports, means of transport, period, and more), with renotification for changes and special rules for pre-consented OECD facilities and for interim operations R12, R13, RC3 or D13 to D15; receipt of EPA's Acknowledgment of Consent (AOC) documenting the consent of the countries of import and transit; a movement document with fifteen listed elements accompanying each shipment from initiation to the foreign facility; the manifest with the foreign facility's name and address, the export box and port of exit on the continuation sheet, and from December 1, 2025 submission to e-Manifest of Page 1 and continuation sheets within 30 days of receiving the export manifest from the final domestic transporter, with the e-Manifest user fee; Electronic Export Information filed in the Automated Export System with the EPA license code, commodity code, consent number, destination, date, manifest tracking number and quantities; the duty to return or re-export where the movement cannot be completed; an annual report to EPA by March 1 on the prior year's exports (with waste minimisation information in even years and a signed certification); exception reports within 30 days where the transporter's departure copy is not received within 45 days, the receiving facility's confirmation within 90 days, or a shipment is returned; and records (notifications, AOCs, movement documents, confirmations, annual and exception reports, contracts) kept at least three years, which may be kept in WIETS, with retention extended during enforcement.
