The level of control depends on the waste's assignment to the OECD Green or Amber list (incorporated by reference in 260.11) and on whether it is hazardous waste: Green wastes that are not hazardous are outside the subpart, while Green wastes that are hazardous, Amber wastes that are hazardous (even where the other country does not treat them as hazardous) and hazardous wastes not yet assigned to a list are subject to it, exporters complying with 262.83 and importers and receiving facilities with 262.84; mixtures follow stated rules. Every transboundary movement of hazardous waste must be destined for a recovery or disposal facility operating or authorised to operate under the importing country's law, must comply with the applicable international transport agreements, and any transit must comply with all applicable international and national laws. Amber-controlled waste transiting the United States without meeting the notification and movement requirements must be returned; waste samples destined for laboratory analysis are exempt within the stated quantity and packaging conditions.
