The generator must sign the manifest certification by hand, obtain the handwritten signature of the initial transporter and the date of acceptance, keep one copy under 262.40(a) and give the remaining copies to the transporter. For bulk shipments solely by water within the United States, three signed copies go to the designated facility or the last water transporter if exported by water; for rail shipments originating at the site, at least three copies go to the next non-rail transporter, the designated facility if solely by rail, or the last rail transporter if exported by rail. Where the designated facility is in an authorized state not yet authorised to regulate that waste, the generator must ensure the facility agrees to sign and return the manifest and any out-of-state transporter forwards it. For rejected loads or container residues returned by the designated facility, the generator must sign Item 20 of a new manifest or Item 18c of the original, give the transporter a copy, send a copy to the returning facility within 30 days of delivery, and keep a copy for at least three years.
