EAR - Export Administration Regulations 764.8: Voluntary self-disclosure of boycott violations

What does 764.8 require?

Possible violations of Part 760 and related Part 762 recordkeeping should be disclosed to the Office of Antiboycott Compliance: an initial written notification as soon as possible, a thorough review (five years recommended), and a narrative account with the violation, when and how it occurred (negotiations, sales, letters of credit, bids), all parties and mitigating factors, supporting boycott documents and a signed certification; it counts only if made with senior management's authorisation and before OAC receives the information elsewhere (including through a mandatory 760.5 report); relevant documents are kept until the matter closes; OAC may take no action, warn, propose or issue charges or refer for prosecution.
