When a coroner (or procurator fiscal) notifies OFCOM of an investigation into a child's death, OFCOM must give the provider of a regulated service of a kind specified in regulations, or one the investigating authority has named, a notice to ensure the retention of information about the child's use of the service, and may give such a notice to other relevant persons. The recipient must take all reasonable steps without delay to stop routine deletion, retain the specified information for one year (OFCOM may extend by up to six months at a time, any number of times, or cancel), and tell OFCOM by the specified date what steps it took or that the child did not use the service or it holds no such information. Deleting or altering the information with intent to keep it from the investigation is an offence, and a named senior manager who failed to take all reasonable steps to prevent it also commits an offence.
