Information standards under the Health and Social Care Act 2012 can now cover information technology and IT services (design, quality, capabilities, functionality, connectivity, interoperability, portability, storage and access, and security of information, and the contracts under which they are supplied) and apply to a relevant IT provider: anyone marketing, supplying or otherwise making available IT, IT services or information processing services used in connection with health or adult social care in England, paid or free. A provider to which a standard applies must comply unless waived (section 250(6A)), must provide documents, records or information the Secretary of State requires to monitor compliance, can be given a notice requesting compliance and evidence within at least 28 days, and can be publicly censured after an opportunity to make representations; an accreditation scheme for health and care IT can be set up by regulations.
