When a lawyer knows that another lawyer has broken the rules in a way that raises a substantial question about honesty, trustworthiness or fitness to practise, the lawyer must inform the appropriate professional authority, and may not make non-reporting of such conduct a term of settling a civil dispute that involves alleged lawyer improprieties. The same duty to inform the appropriate authority arises when a lawyer knows that a judge has broken the rules of judicial conduct in a way that raises a substantial question about fitness for office. Nothing need be disclosed that Rule 1.6 or General Statutes section 51-81d(f) protects, or that was learned while sitting on a bar association ethics committee or the Judicial Branch Committee on Judicial Ethics.
