Australian Education Services for Overseas Students Act 2000 and National Code 2018 (Australia) NC-7.2-7.7: Standard 7.2 to 7.7 Release policy, under 18 transfers, refusals and records

A provider must have a documented transfer request policy and process, available to staff and students, covering how to lodge a request with a valid enrolment offer, circumstances where the transfer is granted as being in the student's best interests (for example inability to progress, compassionate circumstances, failure to deliver the course, unmet reasonable expectations, being misled, or a successful appeal), grounds for refusal and a reasonable timeframe to reply. For under 18s it needs the parent or guardian's written support and the receiving provider's confirmation of welfare responsibility. A granted release is at no cost and the student is advised to contact Immigration. A refusal must be in writing with reasons and the right to appeal within 20 working days, the refusal must not be finalised in PRISMS until appeals end, and request records are kept for 2 years after the student stops being an accepted student.
