Australian Education Services for Overseas Students Act 2000 and National Code 2018 (Australia) NC-7.1-7.1A: Standard 7.1 and 7.1A Restriction on enrolling transferring students (as amended from 2 October 2026)

A receiving provider must not knowingly enrol a student seeking to transfer from another registered provider unless the relevant period has passed: for a releasing approved school provider, the first six months of the first registered school course; for other providers, at least twelve months of the principal course up to 30 June 2027, and at least six months from 1 July 2027. It may enrol earlier if the releasing provider or course has ceased registration, a sanction prevents the student continuing, the releasing provider has agreed to release the student and recorded the date and reason in PRISMS after following its Standard 7.2 process, or a government sponsor supports the change in writing. Compilation No. 1 of the Code still shows the earlier six-month rule; the amendment (F2026L01351) took effect from 2 October 2026.
