Australian Copyright Act 1968 (Australia), Educational Institution Provisions s116AAE: s 116AAE Conditions for limiting remedies when the owner cannot be found

To benefit from the limit on remedies when the copyright owner cannot be found, a user must have conducted a reasonably diligent search within a reasonable period before the use, kept a record of the search for a reasonable period, been unable to identify and locate the owner at the time of use, and given a clear and reasonably prominent notice that the owner could not be found and that the notice is given for this Division. A notice also affects licensed status under s 113Q(2A).
