Where a PCBU has a duty or obligation under the Act, each officer (for a company, a director, secretary or person who makes or significantly participates in decisions affecting the whole or a substantial part of the business) exercises due diligence to ensure the PCBU complies. Due diligence includes taking reasonable steps to: acquire and keep up to date knowledge of WHS matters; understand the nature of the operations and their hazards and risks; ensure the PCBU has and uses appropriate resources and processes to eliminate or minimise risks; ensure it has processes to receive and consider information about incidents, hazards and risks and respond in a timely way; ensure it has and implements processes to comply with its duties (such as notifying incidents, consulting workers, complying with notices, training workers and HSR training entitlements); and verify that those resources and processes are provided and used. An officer can be convicted whether or not the PCBU is.
