The RTO checks whether it or a governing person was previously found not fit and proper under the NVETR Act, the Australian Education Act 2013, the ESOS Act, HESA, the TEQSA Act, the VET Student Loans Act, state subsidy arrangements or any other Commonwealth, State or Territory law; whether past conduct reasonably suggests a deliberate pattern of unethical behaviour; any other relevant previous conduct or involvement; and (item 7) whether the public would be unlikely to have confidence in the person's suitability to be involved in an organisation that provides, assesses or issues nationally recognised qualifications.
